CAPITEC, ANEW HOTEL AND TOP BILLING GIVEAWAY TERMS AND CONDITIONS<\/b><\/p>

Important clauses which may limit our responsibility, place an obligation on you to indemnify us, involve an acknowledgment of any fact or involve some risk for you will be in bold and italics. You must pay special attention to these clauses.<\/i><\/b><\/p>

  1. Introduction<\/b><\/li><\/ol>

    1.1 The Capitec ANEW Hotel Giveaway (Competition) will be run by Cardova Trading (Pty) Ltd in association with Capitec Bank <\/span>Limited and ANEW Hotels<\/span> & Resorts (Organisers\/we\/us\/our).<\/span>
    <\/span>1.2 Each person entering the Competition (<\/span>entrants\/you\/your<\/b>) and\/or accepting a Prize in terms of this Competition agrees and accepts that the Competition rules as set out in these terms and conditions are binding on him\/her.<\/span><\/p>

    1. Competition Period<\/b><\/li><\/ol>

      2.1 Entries for the Competition will open at 19:30 on Thursday 10 September 2026 and will close at 09:00 on Wednesday 16 September 2026.<\/span>
      <\/span>2.2 The organisers reserve the right (on its sole and absolute discretion) to extend, shorten, suspend any or all the Entry Periods or to terminate the Competition for technical, commercial, and\/or operational reasons, or for reasons beyond its control.<\/span><\/p>

      1. Who can enter<\/b><\/li><\/ol>

        3.1 In order to be eligible to enter the Competition:<\/span>
        <\/span>3.1.1. you must be a legal, permanent resident of the Republic of South Africa;<\/span>
        <\/span>3.1.2. you must be at least 18 (eighteen) years of age or older;<\/span>
        <\/span>3.1.3. you must be a natural person.<\/span>
        <\/span>3.2. Notwithstanding clause 3.1, you are not eligible to enter this Competition if:<\/span>
        <\/span>3.2.1. you are a director, member, partner, employee, agent or consultant of the Organisers, or any other person who directly or indirectly controls or is controlled by the Organisers;<\/span>
        <\/span>3.2.2. you are an immediate family member of any of the persons specified in clause 3.2.1; or<\/span>
        <\/span>3.2.3. you are a supplier of goods or services in connection with the Competition.<\/span><\/p>

        1. How to Enter<\/b><\/li><\/ol>

          4.1. We will include 1 (one) Competition post each on Top Billing\u2019s Facebook page (https:\/\/www.facebook.com\/topbillingtv), and Instagram page\u00a0 (https:\/\/www.instagram.com\/topbillingtv\/) (<\/span>Competition Posts<\/b>)<\/span>
          <\/span>4.2. To enter, you must comply with all the following requirements:<\/span>
          <\/span>4.2.1. Reply to the Competition Post during the Competition Period, by answering the question: How you could Live Better with this great escape<\/b><\/span>.<\/b>
          <\/i><\/b>4.2.2. Include <\/span> #BestCreditCardToTravelWith, #BankOnCapitec & #TopBilling <\/b>in your reply; and<\/span>
          <\/span>4.2.3. Follow <\/span>@capitecbank \u00a0and @TopBillingTV <\/b>on Instagram<\/span>
          <\/span>4.3. Once you meet the requirements set out in clause 3 above and this clause 4, you will automatically be entered into the Competition.<\/span>
          <\/span>4.4. You may enter as many times as you like on each platform (provided each entry is unique ie. Not the same answer)<\/span>
          <\/span>4.5. No automated entries will be allowed. Entries must be made manually.<\/span>
          <\/span>4.6. If your entry is submitted in a manner that in the sole discretion of the organisers will provide you with an unfair advantage over other entrants, you will be disqualified from the Competition.<\/span>
          <\/span>4.7. <\/span>You are required to attend to the cost for your entry, including standard internet costs.<\/i><\/b><\/p>

          1. How the winners are determined<\/b><\/li><\/ol>

            5.1.1.A random draw will be conducted through an automated system to determine the Winner from all valid entries on the competition posts.<\/span>
            <\/span>5.1.3. Cardova will notify the Winner by messaging the Winner directly on either Facebook or Instagram (i.e. the platform from which the winning entry was received) within 2 (two) hours from determination of the Winner to request further contact details, a copy of the Winner\u2019s Identification Document (<\/span>ID<\/b>) (as required in accordance with Regulation 11 (6) (o) of the Consumer Protection Act 68 of 2008), contact number, email address and physical address that may be required to validate the Winner\u2019s entry. <\/span>If the Winner does not reply to our message and provide the requested information within 48 (forty-eight) hours from our message being sent, or if we determine in our sole discretion that the Winner was not eligible to enter and or win a prize in the Competition in accordance with these terms and conditions, the Winner will forfeit the prize and have no claim against us and we shall be entitled to select a different winner at our discretion.<\/i><\/b>
            <\/i><\/b>5.1.4. The Winner may be announced on the Top Billing digital platforms operated by the organisers.<\/span><\/p>

            1. The Prizes<\/b><\/li><\/ol>

              6.1. The winner will receive a 2 x night stay for 2 x adults sharing\u00a0 (winner and partner, sharing 1x room) at one of the following ANEW Hotels:<\/span><\/p>

                • ANEW Resort Hazyview Kruger Park<\/li>
                • ANEW Resort Wilderness Garden Route<\/li>
                • ANEW Hotel Ocean Reef Zinkwazi<\/li>
                • ANEW Hotel Hilton Pietermaritzburg<\/li>
                • ANEW Hotel Green Point Cape Town<\/li><\/ul><\/li><\/ul>

                  This prize also includes:<\/span><\/p>

                  • Breakfast included for both mornings<\/li><\/ul>

                    There will be 1 (One) winner for this Competition Period (<\/span>Prize<\/b>).<\/span>
                    <\/span>
                    <\/span>6.2. The Prize excludes all items not mentioned in clause 6.1 and may differ from images or items used in marketing material for the Competition.<\/span>
                    <\/span>
                    <\/span>This Prize <\/span>excludes<\/b>:<\/span><\/p>

                    • All transport, transfers, and flights<\/span><\/li><\/ul>


                      <\/span>6.3. Prize validity:<\/span><\/p>

                      • Valid for 6 x months of date of issue<\/span><\/li>
                      • Prize is subject to availability<\/span><\/li><\/ul>

                        <\/span>6.4 We will contact the Winner to receive all necessary information, which may include (without limitation) the following: Full name, Address, email address, and Contact Number. The Prize voucher shall be delivered to the Winner via email within 30 (thirty) business days from confirmation of the Winner.<\/span>
                        <\/span>
                        <\/span>6.5. The Prize, or any part thereof, may not be exchanged for cash, nor any other item. Prizes are not transferable. We reserve the right to substitute the Prize, or part thereof, with any other prize of a similar commercial value.<\/span><\/p>

                        1. General<\/b><\/li><\/ol>

                          7.1 You may only win one Prize for this Competition. For the avoidance of any doubt, if a person is determined a Winner for one Entry Period, that person will not be eligible to win Prize for any of the subsequent Entry Periods for this Competition.<\/span>
                          <\/span>7.2 Any reference to the organisers includes the directors, members, partners, agents or consultants of the organisers, where the context allows for it.<\/span>
                          <\/span>7.3 We reserve the right to amend these terms and conditions should it be deemed necessary in our sole and unfettered discretion.<\/span>
                          <\/span>7.4 The organisers\u2019 decision regarding any matter concerning the Competition and\/or arising out of these terms and conditions, including the determination of the Winner, is final and no correspondence will be entered into except where otherwise provided for in the Consumer Protection Act, 68 of 2008.<\/span>
                          <\/span>7.5 Where relevant, if a Winner does not accept the Prize as required herein, if an entry is not valid for whatever reason, if a Winner has breached these terms and conditions, if a Winner renounces the Prize or we deem such Winner to have renounced the Prize, we reserve the right to declare the Prize forfeited and\/or to choose a new Winner.<\/span>
                          <\/span>7.6 Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrants or the organisers in terms of the Consumer Protection Act, 68 of 2008.<\/span>
                          <\/span>7.7 By entering this Competition, the entrant consents to the collection, processing and further processing of his or her personal information (including personal information contained in electronic communications) by us for the purposes of conducting this Competition and facilitating the entrant\u2019s participation in the Competition. Except where prohibited by law or where objected to by the individual at any time, the Winner grants permission for us and those acting under our authority to use his or her name, and or photographs, and or voice for purposes of announcing the Winner and related advertising purposes, in any form of media and without additional compensation, notification or permission. A Winner may at any time decline an invitation use, or object to the use of, his\/her image in marketing material.<\/i><\/b>
                          <\/i><\/b>7.8 By posting any content, images, or comments on any of the organiser\u2019s public and\/or social media platform or by sending any such content to the organisers, an entrant consents to and gives the organisers a world-wide royalty free licence to reproduce, modify, adapt and publish such content, images or comments for the purposes of promoting the organiser\u2019s products and\/or services.<\/span>
                          <\/span>7.9 By entering the Competition, the entrant unconditionally and irrevocably indemnifies and holds harmless the organisers, as well as its holding company, its subsidiaries and any subsidiaries of its holding company, and their successors and assigns, directors, employees, agents or consultants against all and any losses, claims, proceeding, actions, damages (direct, consequential or otherwise), liability, demands, expenses, legal costs (on an attorney and own client basis), injuries howsoever arising out of, based upon, or in connection with (directly or indirectly) the entrant\u2019s participation in the Competition and or the use of the Prize. By accepting the Prize, the Winner accepts the Prize at his\/her own risk.<\/i><\/b>
                          <\/i><\/b>7.10 The organisers and its service providers, are not responsible for:<\/i><\/b>
                          <\/i><\/b>incorrect and inaccurate transcription of entry information;<\/i><\/b>
                          <\/i><\/b>7.10.1 technical malfunction;<\/i><\/b>
                          <\/i><\/b>7.10.2 inappropriate images and comments posted by the entrant or by the public;<\/i><\/b>
                          <\/i><\/b>7.10.3 lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network or computer equipment or software; and\/or<\/i><\/b>
                          <\/i><\/b>7.10.4 the inability to access any website or online services or any other error.<\/i><\/b>
                          <\/i><\/b>7.11 If required by the Minister of Trade and Industry, the National Consumer Commission or for whatever other reason, we will have the right to modify or terminate this Competition with immediate effect and without notice of such modification or termination. In such event, all entrants hereby waive any rights, which they may have against us and hereby acknowledge that they will have no recourse or claim of any nature whatsoever against us.<\/i><\/b>
                          <\/i><\/b>7.12 <\/span><\/i>The Competition is in no way sponsored, endorsed or administered by Facebook or Instagram and any correspondence related to the Competition should be directed at us and not Facebook and Instagram.<\/span>
                          <\/span>7.13 <\/span><\/i>We may require the Entrant to:<\/span>
                          <\/span>7.13.1 <\/span><\/i>to provide his\/her name, proof of address, identity number and cell number to enable us to verify the entry;<\/span>
                          <\/span>7.13.2 <\/span><\/i>Where the entry includes the submission of any work eligible for copyright in terms of the Copyright Act No. 98 of 1978, conclude an agreement of assignment whereby any rights which the entrant may have in respect of such works are transferred to us.<\/span>
                          <\/span>7.14 <\/span><\/i>We reserve the right to disqualify any entrant suspected of fraud or cheating including without limitation, through the manipulation of code or otherwise falsifying data.<\/span>
                          <\/span>7.15 <\/span><\/i>We reserve the right to remove \/ delete any entries which are in our sole and unfettered discretion deemed to be obscene and or offensive.<\/span>
